Terms & Conditions
Orders must be paid in full upon checkout via this website 4 weeks prior to event date unless confirmed with owner in advance. 50% of all payments received are reserved as a non-refundable retainer which goes toward but not limited to: reserving your date, supplies and time developing a design for your order.
Each treat is handmade. No treat will be precisely the same. B.Creative Confections reserves the right to interpret and design treats based on theme, event type, color scheme, and inspiration pictures provided. Treats are subject to the designer's discretion creating a fantastic element of surprise.
Color matching will be attempted. A perfect color match can not be guaranteed.
B.Creativ Confections packs and ships your items with care so they arrive safely and intact.
TRANSPORTING & STORAGE:
Customer or person customer has allowed to pick up order is responsible for transporting your order home safely & we are not responsible once an order leaves our premises. All treats should be transported in vehicles with air conditioning April 1st- October 10.
Store treats at room temperature (unless otherwise stated). If items will not be consumed within 24 hours and are not heat sealed place treats in an air tight container or bag and remain at room temperature. Do not place treats in direct heat or sunlight. Temperatures over 70 degrees Fahrenheit are not suitable for treats. We cannot be responsible for damages that occur due to heat over the stated temperature.

We are not responsible if information made available on this site is not accurate, complete or current. Prices for our products and/or services are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
INDEMNIFICATION:
You agree to indemnify and hold B.Creativ Confections harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.
PREFERENCE OF LAW & DISPUTE RESOLUTION:
These terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of the United States, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in the state of Michigan. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.
FEEDBACK & SUGGESTIONS:
If you provide us with any suggestions, comments or other feedback relating to Our Products and/or Services (whether existing, suggested or contemplated), which is or may be subject to any Intellectual Property rights (“Feedback”), such Feedback shall be exclusively owned by B.Creativ Confections. By providing such Feedback to B.Creativ Confections you acknowledge and agree that it may be used by B.Creativ Confections in order to: (i) further develop, customize and improve Our Services, (ii) provide ongoing assistance and technical support, (iii) contact you with general or personalized B.Creativ Confections-related notices and/or interview requests based on your feedback or otherwise, (iv) facilitate, sponsor and offer certain promotions, and monitor performance, (v) to create aggregated statistical data and other aggregated and/or inferred information, which We may use to provide and improve its services, (vi) to enhance Our data security and fraud prevention capabilities, and (vii) to comply with any applicable laws and regulations. In addition, you (1) represent and warrant that such Feedback is accurate, complete, and does not infringe on any third party rights; (2) irrevocably assign to B.Creativ Confections any right, title and interest you may have in such Feedback and (3) explicitly and irrevocably waive any and all claims relating to any past, present or future moral rights, artists’ rights, or any other similar rights worldwide in or to such Feedback.
